1 - Introduction

These General Terms and Conditions of Sale and Warranties (hereinafter "General Terms and Conditions of Sale and Warranties") govern only contractual relations between the customers of the site mrwolf.bike (hereinafter referred to as "Customers") and the seller MrWolf s.r.l.  – VAT Number  IT03886500986 (hereinafter referred to as "Seller"). These General Conditions are the only ones that can be applied and replace all other conditions express or written exception for preliminary exemptions. The Seller may be required to modify some of these conditions. We therefore recommend that Customers read the General Terms and Conditions of Sale and Warranties at each purchase on the site mrwolf.bike (hereinafter referred to as "the Site"). Every purchase on the Site is subject to the General Terms and Conditions of Sale and Warranties applicable on the order date. The Seller acknowledges that once the order has been validated, Customers have read and accepted without reservation the General Terms and Conditions of Sale and Warranties. Customers undertake to comply the General Terms and Conditions of Sale and Warranties detailed in the 22 sections in this paragraph.

Our website mrwolf.bike sells high-tech and innovative bicycle accessories. The sale is made exclusively through our Online Site at http://shop.mrwolf.bike, owned by the Seller. The seller sales goods or services through the Online Sale, that is a contract made exclusively within the commonly used communication system Called internet.

 

3. Products’ Order

Our products can be ordered from our website http://shop.mrwolf.bike 24 hours a day and 7 days a week.

The cash order procedure is composed of the following steps. Once the products have been selected and the cart is validated, Customers will be at checkout:

- choose whether to create an account or proceed as a guest - alternatively if you are already a registered user, log in

- Enter your buyer's details and choose whether to send to another address other than the sender's address

- If item 2 is chosen for different shipping address, enter the data of the shipping address

- choose the payment method between the various options offered

- check the order, correctness of the entered data and confirm the purchase

In order to confirm the purchase, the customer will have to accept the General Sales Terms that will definitively formalize the sales contract that links them to the Seller.

All information about the features, descriptions, illustrations of the products of our site are provided by our suppliers or made by our staff. If necessary, the Seller reserves the right to modify or adjust the catalog information of the product without prior notice.

 

5. Sales Prices

All sales prices of the products indicated on the Site in the catalog are expressed in Euros as a final price but do not include the shipping or marking rights that are always charged to Customers. The Seller reserves the right to change the prices at any time without notice, but undertakes to apply the same prices on the Site at the time the order is made.

 

6. Minimal order

There is no minimum order quantity available, you can also order a single product.

 

7. Products’s Availability

Availability of products is always indicated and updated 95% in our online catalogs on our site. The state is divided into two categories:

- available

- not available

If the item you buy is no longer available, the Seller will contact you via email or telephone within 24 hours of your purchase, informing you that your item is not available, offering three possible solutions in the following order of priority:

- replacement with another item of the same value, in case of lower cost, the Seller will reimburse the difference, in case of higher cost, the Customer shall supplement the payment of the missing difference

- If the customer has purchased more than one item, partial refund of the amount of missing item

- If the customer has purchased only one item, the total refund of the order.

 

8. Accepted Payment Methods

The Seller uses the PayPal payment method to ensure customer payment security and the confidentiality of credit card information used. Other payment methods are possible by bank transfer, marking method (cash payment upon arrival of the goods, directly to the courier | will be added an extra cost of 7 Euros for the right of mark, even if free shipping). In case of shipping to Calabria, Apulia, Sardinia and Sicily, delivery time is estimated at least 24/48 hours more than the rest of the regions.

11. Delivery Methods in Italy

Shipments proposed by the Seller are made in Italy with UPS or BRT courier. Products purchased on our Site are delivered only in Italy, excluding the locations of San Marino and Livigno. The Seller reserves the right to modify the couriers or delivery methods at any time without prior notice, but undertakes to equally apply couriers and delivery methods as indicated on the Site at the time the order is made.

 

12. Delivery Methods in Europe

Shipments proposed by the Seller are made in Europe with UPS courier parcel. Products purchased on our Site are delivered to Europe except Cyprus, Croatia and Malta. The Seller reserves the right to modify the couriers or delivery methods at any time without prior notice, but undertakes to equally apply couriers and delivery methods as indicated on the Site at the time the order is made.

  

13. Pictures, Texts, Graphics

All images and texts of the products on our Site are covered by copyright and are owned by the manufacturers or suppliers or by MrWolf srl. Their use is granted to the Seller as an authorized seller, or because of the purchase of the products by the wholesaler or factory that supplies original items with the any contributes absolved. Any abuse and/or non-compliant use will be prosecuted under the terms of the law.

 

14. Warranty

MrWolf srl is not responsible for any damage or accident resulting from the products sold that may occur if the customer uses the products improperly and without following the instructions provided, with particular reference to Banger's assembly.

Because of the heavy nature of offroad use, the product is no longer covered by warranty after it has been mounted.

The warranty is valid only on defective material of the product not yet assembled.

Each customer is responsible for the correct use of the product purchased by MrWolf srl.

In any event, the limit of our responsibility may not exceed the selling price of the product.

16. Right Of withdrawal - D.LGS N.206 / 2005

You have the right to withdraw from the contract, without giving any reasons, within 14 days. The withdrawal period expires after 14 days from the day you or a third party, other than the carrier and you designated, acquires the physical possession of the goods. In order to comply with the term of withdrawal, it is sufficient that you send a notice regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.

 

16.2 Effect of withdrawal

If you withdraw from this contract, you will be refunded all payments you made to us, including delivery costs (except for additional costs related to your choice of a delivery type other than the cheapest standard delivery type We offer) without undue delay and in any case not later than 14 days from the day we are informed of your decision to terminate this contract. These refunds will be made using the same payment method you have used for the initial transaction, unless you have otherwise agreed. In any case, you will not charged of any cost as a consequence of such redemption. Refunds may be suspended until receipt of the goods or until the consumer demonstrates that good’s have been returned if earlier. It is required to return the goods to MrWolf srl, Via Trieste, 48 - 25121, Brescia (BS) without undue delays and in any case within 14 days of the day on which he has notified us of his withdrawal from this contract. The term is respected if you return the goods before the expiration of the 14-day period. The direct costs of returning the goods will be at your own expense, you can follow two ways:

- request the withdrawal by our courier at the cost of € 9.90 (for Italy) or, for the rest of the world, at cost indicate at the previous section 10) for orders over 199,00 EURO;

- carry out the shipment independently by using a courier.

You are only responsible for the diminution of the value of the goods resulting from manipulation of the goods other than the one necessary to establish the nature, characteristics and operation of the goods.

 

16.3 Exclusion of withdrawal

The right of withdrawal can not be exercised after the product has been mounted or when signs of wear or abrasion on the surface of the product are noticeable.

16.4 Changing gear sizes

If, once received the goods, the Customer notices that he has purchased an incorrect size, the Seller allows to change the product within 14 days from the date of receipt, provided that the product has not been used, assembled or damaged. The Seller will not accept any changes or returns of used or damaged products.

In the case of lack of availability of the affected size, it will be possible to change the model with another by agreement with the Seller.

Any return of the purchased items must be carefully packaged and include the delivery receipt or the duly completed return form.

If Customer do not have a delivery note at the time of the change, has to download the return form by accessing the merchandise returning page (in the My Orders section of My Account if the user has registered or in the Orders section if The user is not registered) available on mrwolf.bike.

Please return the goods to MrWolf srl (C/O Carpe Diem), Via Caravaggio, 5 - 25013, Carpenedolo (BS) without undue delays and in any case within 14 days of the day you informed us of your intention to change the size of the product. The term is respected if you return the goods before the expiration of the 14-day period.

The direct costs of returning the goods will be at Your expense, you can follow two ways:

- request the withdrawal by our courier at the cost of € 9.90 (for Italy) or, for the rest of the world , at cost indicate at the previous section 10) for orders over 199,00 EURO;

- carry out the shipment independently by using a courier.

The direct costs of sending the product with the correct size from the Seller to the Customer will be:

- charged to the customer in the case of a single product with a selling price less than 199 euros (at the cost of 9.90 euro or)

- charged the the Seller in the case of a single product with a selling price greater than 199 euro.

 

17. Responsibility

The Seller assumes no responsibility for disagreements due to force majeure which prevented, in whole or in part, from being executed in the times agreed upon by the contract. Seller will not be liable for any damages, losses and / or costs incurred as a result of failure to perform the contract for the aforementioned causes, since the buyer is only entitled to the refund of the price paid.

In contracts that charge the seller the obligation to provide goods, the risk of loss or damage to the goods remains the responsibility of the Seller until the Customer enters physical possession of the goods. If, however, the Customer proposes means of transporting the goods that are alternative to those proposed by the Seller then the risk of shipment remains the responsibility of the Customer, without prejudice to Customer's right to the carrier.

Unless otherwise agreed by the parties to the sales contract, the Seller is obliged to deliver the goods to the consumer without unjustified delay and at the latest within thirty days from the date of termination of the contract. The delivery obligation is fulfilled by the transfer of material availability or anyway of the control of the goods to the Customer. If the Seller fails within the time limit, the Customer invites you to deliver within an additional time appropriate to the circumstances. If the additional term thus granted expires without the goods being delivered, the Customer is entitled to terminate the contract.
